An Act to Amend Title 26 of the Delaware Code Relating to Portable Solar Generation Devices
Latest Action: March 26, 2026
Everything you need to know about plug-in balcony solar in Delaware: legal status, tracked bills, statutory wattage limits, utility interconnection rules, and expected monthly solar production.
Current Disposition: Balcony solar bill failed
Delaware has no law addressing balcony solar. Senate Bill 270 (2026) would have created a portable-solar generation-device pathway and directed a safety study. It was assigned to the Senate Environment, Energy and Transportation Committee on March 26, 2026 and received no further action before the 153rd General Assembly recessed.

Moveable photovoltaic generation device with a total maximum power output per utility meter of not more than 800 watts; connects through a standard 120-volt AC outlet; intended to offset part of consumption; meets current NEC as adopted by the Office of the State Fire Marshal; certified by UL or equivalent.
Meeting device is exempt from interconnection requirements, interconnection agreements and net-metering program requirements unless the customer intends to engage in net metering; device must include UL 1741 (or successor) anti-islanding and be installed per the latest revision of IEEE 1547.
26 Del. C. Sec. 1022(b)(1)-(2)
Utility may not require prior approval, fees (except net-metering interconnection charges) or extra controls; not liable for damage/injury; must establish an online registration system by 2027-01-15 and must prevent registered customers from being charged for excess generation.
The Delaware Sustainable Energy Utility must study the safety of portable solar generation devices and report findings and recommendations by 2027-01-01.
